Welcome to the DLUK online central website (the 'Site'). DLUK is the abbreviated trading name for Datalite UK Ltd.  Should you use the Site, including purchasing any goods from or arising from the Site including our branding names and subsidiary online store websites:

you will be contracting with Datalite UK Limited (also referred to as DLUK) on the terms outlined below. Please read these terms and conditions carefully.

Part 1 - General Terms and Conditions

These are the general terms and conditions of DLUK governing your use of this Site.

1. Definitions

In these terms and conditions, the following definitions apply:

'DLUK' (also referred to as 'we' and 'us') means Datalite UK Limited, the United Kingdom based company headed by Managing Director John D Henry BA BSc.  This business is registered with HM Revenue and Customs in the United Kingdom, and is a Registered Limited Company with Company House in the United Kingdom .  DLUK’s Registered Office and Retail Premises is located at:  Datalite UK Limited, Timbers, 134 Broadway, Sandown, Isle of Wight, PO36 9AQ. 

'Site' means the DLUK e-commerce web site located at www.dluk.info and also all DLUK subsidiary websites, as listed above.

‘Sales Terms’ means terms and conditions related to goods purchased from the Site.

2. What you are allowed to do

2.1 purchase goods from this Site, provided you accept the Sales Terms, which will apply to any contract made between you and DLUK for the purchase and sale of goods from this Site. These terms may be reviewed in Part 2 below;

2.2 browse the Site using a compatible web browser. Permission to browse the Site includes permission to make transient or cached copies of parts of the Site to the extent that this occurs in the normal course of using your browser and that these copies are used only to facilitate current or subsequent access to the Site by you;

2.3 print a copy of any page of the Site; for your own personal purposes, provided you do not do any of the things set out under ‘What you are not allowed to do’.

3. What you are not allowed to do

3.1 if you are under 18, you may not directly purchase from this Site. However, we welcome parents and legal guardians buying suitable products on behalf of individuals under 18;

3.2 except to the extent expressly set out in these terms, you are not allowed to make any copies of any part of the Site;

3.3 you may not remove or change anything on the Site;

3.4 you are not allowed to copy or use any material from the Site for any commercial purpose without the written permission from DLUK;

3.5 you are not allowed to remove or change any copyright, trade mark or other intellectual property rights notices contained in the original material or from any material copied or printed off from the Site.

4. Your personal information

4.1 Usage of your personal information is governed by DLUK's Privacy Policy, which forms part of these Terms and Conditions.

5. Rights

5.1 All intellectual property rights in any material (including text, photographs and other images and sound, trade marks and logos) contained in this Site is either owned by DLUK or has been licensed to DLUK by the rights owner(s) so that DLUK can use this material as part of its Site. You are only allowed to use this Site and the material contained in the Site as set out in these terms.

6. Third party web sites

6.1 This Site also contains links to other third party websites, which are not under the control of and are not maintained by DLUK. Any such links do not constitute an endorsement by DLUK of any products or services available on such Sites. DLUK provides these links for your convenience only and you use such links entirely at your own risk. We accept no responsibility for the content or use of such Sites or information contained in them.

7. Suspension of Site

7.1 DLUK may suspend the operation of the Site for repair or maintenance work or in order to update or upgrade the contents or functionality of the Site from time to time. Access to or use of the Site or any Sites or pages linked to it will not necessarily be uninterrupted or error free;

9. General and governing law

9.1 DLUK may change these terms and conditions from time to time and will endeavour to notify you of any major changes by posting a message on the Site. By browsing the Site you are accepting that you are bound by the current terms and conditions. Please review this policy each time you use the Site as it is subject to change at any time by DLUK without notice to you;

9.2 These terms and conditions shall be governed and interpreted in accordance with English law, and you consent to the non-exclusive jurisdiction of the English courts in respect of any dispute arising there from.

Part 2 - Terms and Conditions of Sale (‘Sales Terms’)

Note: The following Sales Terms relate to orders from individual consumers.

1. The Sales Terms

1.1 These Sales Terms govern the supply of any goods or services you order via this Site either directly or through subsequent telephone, correspondence, fax, eMail or other similar communication. Please read through the Sales Terms carefully. If you do not agree with the Sales Terms, do not order any goods from this Site. If DLUK accepts any order for goods from you, then its agreement with you will be made on these Sales Terms.

1.2 Please note that DLUK reserves the right to amend the Sales Terms from time to time. DLUK will publish the amended Sales Terms on the Site and any new versions of the Sales Terms will come into effect as soon as DLUK publish them on the Site (with the exception that any orders that DLUK have already accepted from you prior to any such change will be subject to the Sales Terms in force at that point). If you use the Site after DLUK has published the new Terms, your continued use of the Site indicates that you agree to be bound by the new Sales Terms.

2. Availability of the goods supplied by the Site

2.1 DLUK may terminate or suspend the supply of any goods displayed on the Site in the event of out of stock, for support or maintenance work, in order to update content or for any other reason. DLUK may do this at any time and without notice.

3. Buying goods from this Site

3.1 Pricing policy

DLUK may change the prices of the goods displayed on the Site at any time. The prices for all the goods available on the Site are clearly marked in their description and the VAT breakdowns are listed as well. All applicable delivery (including packing) charges are also displayed on the Site.

3.2 Conclusion of Contract of Sale

The information relating to DLUK's goods and relevant prices are displayed on the Site for your information and to enable you to decide whether you would like to make us an offer to purchase any such goods. Once you go to the order page of the Site, clicking to purchase any of the goods and submitting your order constitutes an offer made by you to us. Acceptance of your offer only occurs once you receive e-mail notification from us of our acceptance of your order at which point there will be a binding contract between you and us.

3.3 Method of payment

For orders placed via the Site, DLUK accepts  Paypal, and Credit or Debit Cards such as Mastercard, Visa, American Express, Delta and Visa Electron cards. When making your payment, it is imperative that you provide the information that DLUK specify is required, for example, cardholder's name as it is shown on the card and address exactly as it appears on the card statement. Your card will be debited when DLUK confirms that it has accepted your order. Ownership or title to the product shall not pass to you, the buyer, until DLUK has received payment in full.

3.4 Delivery

Applicable Delivery charges for orders are based on pre-determined weight bands supplied by the courier companies contracted by DLUK  and by Royal Mail Post Office. The charge covers packing, handling and delivery. Orders are usually responded to within 24 hours.  For all products other than those ordered from the Frames Online UK - Bulk Supply range, orders will normally be despatched within two working days for courier and Royal Mail First Class delivery options, and three working days for Royal Mail Second Class/Airmail post.   These targets may exceptionally be extended up to 7 working days, particularly applicable if a product requires manufacture to order.

Delivery method will depend on option(s) available and selected on website. Generally delivery for smaller items (up to around 2kg) within the United Kingdom will be by Royal Mail First Class post.  Larger items to Mainland UK are normally delivered by courier service (1-3 working days); for UK Deliveries outside the Mainland (such as Northern Ireland, Scottish Islands, and Isle of Man) delivery will normally be Parcel Force which on average takes 3-5 working days.

Delivery outside the United Kingdom is usually by Royal Mail Airmail, which can take up to a week (or more in some cases depending on local conditions) for goods to arrive. Only small deliveries (up to 2kg) can normally be accepted for worldwide despatch without prior arrangement.  Due to greatly increased risk of breakage during transit, high cost, and safety considerations it is DLUK's policy to avoid despatch of any product containing glass by Airmail, unless by prior arrangement.  Overseas orders of A4 framed products will generally use Acrylic 'glass' rather than traditional fragile glass.

Products ordered from the Frames Online UK - Bulk Supply range will normally be despatched via pallet within 7 working days, but this may exceptionally be extended up to 14 working days.  Please allow up to 14 days for delivery. Please note all orders with the sole exception of downloadable digital products will incur a delivery charge.

Most courier companies will  try several attempts to deliver items, and DLUK will endeavour to contact customerson knowledge of a failed delivery attempt to liase a successful delivery.  If it is necessary for the courier company to return goods to supplier, DLUK may charge additional delivery charges for the consignment to be despatched again.

If you would like your goods delivered to a different address to your home address, then please fill in the details in the appropriate area on the online check out form. Please note that we can only accept one address per order. You will still need to supply us with your own name and address.

Please note items may be dispatched in more than one package, and will not necessarily arrive at the same time. If you have not received your goods within a reasonable timeframe, please contact DLUK on +44 (0)1983 716160 or email: sales@dluk.info.

3.5 Out of stock

If any item you have chosen is unavailable, DLUK will contact you via phone or your email address and set out the options that are available to you.

3.6 Return of goods policy

We want you to be completely satisfied with your purchases, as do the producers who made them. Please let us know if you are not entirely satisfied with our products or our service, so that we can rectify the situation. We try to ensure that the products are the same as our original samples, although sometimes differences do occur. Items are described and photographed as accurately as possible, but please note that sizes, colours and designs may vary.

If the product is damaged in any way or has become broken in transit please call us on + 44 (0)1983 716160 or email: enquiries@dluk.info.  The company will seek an equitable solution to promptly resolve the situation, and will normally offer the customer a replacement, credit, or refund.  Customers are advised not to sign delivery receipts as correct unless goods have been unpacked and examined, otherwise the delivery receipt should be annotated as 'unopened'.  Where possible customers are advised to take digital photographs of damaged items, these may be requested to support insurance claims and improve future processes. 

3.7 Cancellation Policy

Please note that you have a legal right to cancel your order within 7 days of the date of receipt of the goods (provided the goods are returned to us new and in an unused condition in the original packaging together with a copy of the delivery note).  This right may not extend to personalised gift items or custom made merchandise such as Frames Online UK Bulk Supply products which are generally custom manufactured to order.  By returning, packing securely and enclosing the delivery note and sending it back to: DLUK a refund will be provided within 30 days of the date of cancellation.  The cost of delivery may not be refunded unless the goods are faulty and we cannot accept any responsibility for any loss or damage to goods in transit when being returned. A return administration fee of up to 10% or £20 whichever is greater may be applied.  Exercising this right for provision of digital goods will mean you will no longer be legally entitled to use any software products or to offer them for resale if applicable.

3.8 Returns Policy

In addition to your legal rights, DLUK operates a 30 Day return guarantee.  If you are not satisfied with your goods, you may return them in mint condition in the original packaging, together with a copy of the delivery note for a refund.  By returning, packing securely and enclosing the delivery note and sending it back to: DLUK a refund will be provided within 30 days of the date of receipt of the refund request.  The cost of delivery may not be refunded unless the goods are faulty and we cannot accept any responsibility for any loss or damage to goods in transit when being returned.  A return administration fee of up to 10% or £20 whichever is greater may be applied.  DLUK reserves the right to refuse to operate this refund policy in its sole discretion if abuse of this facility is suspected.  Exercising this returns policy in the case of digital goods purchased will mean you will no longer be legally entitled to use any software products or to offer them for resale if applicable.  This returns policy also implies that goods should be checked, and any discrepancies reported to DLUK within 30 days of receipt.

3.9 Services Only Order (i.e. Photography & Digital Filming)

These services will be subject to separate contract, that covers the exigencies of the service provided.  It is highlighted that whilst every reasonable precaution is taken to ensure a successful service  (i.e. by having readily available back-up equipment, use of multiple cameras, and dual SD back-up); the limit of liability in the unlikely event of failure to provide service is to the full retail amount paid cost of the service.

 Customer Service

4.0 DLUK values customers and will do its utmost to ensure to customer service.  As in all organisations the company is not infallible and other organisations outside the company's direct control are not infallible either.  The company will endeavour to resolve any problems and customer dissatisfaction as efficiently as humanly possible. 

4.1 Abuse of Datalite UK Ltd Employees & Equality Act of 2010

The company will not condone any abuse to its employees including management staff and directors.  This includes any abuses connected with protected characteristics under the UK Equality Act of 2010; but also any physical attacks, verbal or written abuse where foul language or personal derogatory statements are involved.  The company will fully support the employee (including Management/Directors) subjected to such abuse, whether from customers or other employees . Such behaviour will result in a permanent ban of the individual from all DLUK premises and withdrawal of any future business facility.  In the case of an employee, disciplinary action will be taken  following investigation procedures, and will likely to result in instant dismissal for gross misconduct.  Additionally, in all cases if a criminal act has been committed, the police will be informed.
